In 2018, the Michigan Legislature repealed Michigan’s prevailing wage statute following a citizen led initiative to repeal the same. A group supporting prevailing wage law, Protect Michigan Jobs, recently challenged the validity of the repealing statute arguing that the statute was invalid as unconstitutional.
The Michigan Court of Claims recently issued an opinion upholding the repealing statute and rejecting the constitutional challenges advanced by Protect Michigan Jobs. At this point, it is unclear whether Protect Michigan Jobs will appeal the decision of the Michigan Court of Claims to the Michigan Court of Appeals. If that occurs, the decision of the Michigan Court of Claims will stand unless and until an appellate court reverses that decision. Notably, that decision will not be reached for some time as the appellate process can take more than a year in some instances.
